Article 1 (Purpose)
The purpose of this agreement is to regulate the rights, responsibilities and duties of users as they use internet related service(henceforth "service") provided by internet website (www.eastarjet.com) operated by Eastar Jet Inc(henceforth Eastar Jet).
Article 2 (Definition)
① "Eastar Jet’s website" is virtual business site which uses computer and other communication devices and information network system in order to provide Eastar Jet’s information and service to the users.
② "Users" are members and non-members who access Eastar Jet’s website for services provides by Eastar Jet followed by this agreement.
③ "Members" are individuals over age of 14 who joined membership of Eastar Jet’s website by providing personal information thus being able to use information and services constantly provided by Eastar Jet’s website.
④ "Non-members" are those who uses information and services provided by Eastar Jet without joining membership.
Article 3 (Agreement’s clear statement and amendment)
① Eastar Jet provides contents, firm mark, CEO’s name, address, business license number, mail-order business license number and other information on the initial screen so the users can know. However, the contents of agreement can be viewed as users proceed to the next screen.
② Eastar Jet can amend this agreement as long as they do not violate legislations regarding this agreement, Framework Act on Electronic Commerce, Digital Signature Act, the law regarding the promotion of information and communication network use and protection of information, Consumer Protection Law, legislation regarding consumer protection on e-commerce and other related legislations.
③ When amending the agreement, the reason for amendment and date of effect will be stated along with current agreement from 7 days prior the effective date on the initial screen. If amendment is unfavorable to consumer, it will be shown on the initial screen 30 days prior to the effective date.
④ As long as amendment of agreement does not violate related legislation, it will be applied to members who joined before amendment as well. However, those who make it clear to refuse amended agreement to Eastar Jet will be applied with agreement before amendment.
⑤ Issues not determined in this agreement and interpretation of this agreement will be followed by the act on the consumer protection in the electronic commerce transactions etc, Regulation of Standardized Contracts Act, Electronic Commerce Consumer Protection Act, relevant act and commercial practice.
Article 4 (Business tasks of Eastar Jet’s website)
Business tasks performed by Eastar Jet’s website is as follows.
① Information service regarding airline tickets, travelling and etc.
② Purchasing contract for airline ticket and conclusion of contract
③ Other tasks decided by Eastar Jet
Article 5 (Halt of service)
① Eastar Jet could temporary stop the service from the website during inspection/maintenance/replacement/break down/communication interruption of computers and other communication devices.
② If service is halted due to reasons mentioned in section 1, Eastar Jet needs to notify users using methods stated in article 8.
③ If service is temporary halted due to reasons mentioned in section 1, Eastar Jet will compensate for any damage the third party receives. However, Eastar Jet won’t be held responsible if they are not liable for it.
Article 6 (Joining membership)
① Users will show their intention to agree to this agreement and enter their membership information followed by the application form and request for membership.
② Eastar Jet accepts user’s request to join for membership as long as they do not fall under the following categories.
A. If applicant for membership loses the right to join membership due to section 4 of article 7. However, if 1 year has passed since the right is lost, applicant may re-apply for membership again.
B. If there are false or omission in the registered contents
C. If it is determined that registering as a member is technically hindering
③ The contract for joining membership is established when Eastar Jet’s approval reaches the member.
④ If there is a change in section 1 of article 13, the member must make notification thought e-mail or other means necessary.
Article 7 (Withdrawing membership or losing the right)
① Members can withdraw membership at any time, and Eastar Jet will accept their withdrawal immediately.
② If a member falls under any following categories, they can limit or stop services.
A. False information was registered when joining or a member joined with 2 or more IDs
B. Payment for airline tickets purchased from Eastar Jet’s website or any other liabilities that member must pay is not made
C. Disturbing and threatening order of e-commerce by interrupting others’ use of website or pirating personal information of others
D. Committing acts forbidden by this agreement or against good public order and customs using Eastar Jet’s website
③ When the company limits or halts the use of Eastar Jet’s service, they will notify users the reasons, effective date and duration using e-mail, phone or in writings. However, in emergency, they can notify the users after necessary measures are taken.
④ If acts which caused services from Eastar Jet to be limited or halted are repeated or not fixed within 30 days Eastar Jet can deprive membership.
⑤ If a member’s membership is deprived, member registration will be deleted and member will be notified before deletion takes place.
⑥ Eastar Jet won’t be held responsible for any losses from limit, halt and loss of membership.
Article 8 (Notification to members)
① Notification to members can be made to e-mail addresses members submitted.
② If Eastar Jet makes notification to many and unspecified members, the notification will be posted for over a week but duration of notification can be reduced or omitted. However, issues which has critical influence on member’s business will be notified individually.
Article 9 (Purchase request)
User can use the following methods to request for purchase.
① Enter name, address and phone number
② Choose goods or services
③ Choose payment method
④ Show intention to agree to this agreement
Article 10 (Establishment of contract)
① Eastar Jet will accept request purchase followed by article 9 as long as it does not fall under the following categories.
A. There is false, omitted and misleading information
B. It is determined that accepting purchase request will bring business or technical hindering
C. Amount of purchase requested is determined to be abnormal in social norms
② The contract is considered to be established moment Eastar Jet’s approval reaches user in form stated in section 1 of article 12.
③ Eastar Jet’s approval(confirmation to accept) to accept user’s purchase request will include information regarding confirmation to user’s request, salability, revision and cancellation of purchase request and etc.
Article 11 (How to pay)
Payments for goods and services purchased at the website of Eastar Jet can be selected from one of the following options.
① Credit card.
② Other payment methods decided by Eastar Jet.
Article 12 (Change and cancelling confirmation of receipt and purchase request)
① When user makes a purchase request, Eastar Jet will send e-mail to the user for confirmation of receipt.
② After user receives confirmation of receipt, user can request to change or cancel purchase request If there are any disagreements in intentions.
③ If user makes a request to change or cancel purchase request, the company will accept their request as long as the circumstances permit.
④ When having to deal with refund or additional fee for changing or cancelling purchase request, member must follow "Eastar Jet domestic/international flight transportation agreement".
Article 13 (Protection of personal information)
① When collecting user’s information, Eastar Jet collects minimum amount of information required for providing service or for carrying out purchase request. Personal information collected under agreement of Eastar Jet user is divided into mandatory information and non-mandatory information followed by personal information policy.
② Eastar Jet always earns user’s consent when collecting user’s personal information. However, in the following cases, they might not.
A. There is a special regulation in the legislation
B. Personal information is required to carry out the contract for service and consent can’t be earned due to economic, technical and commerce reasons
C. Required for settling payment of provided service
③ Provided personal information cannot be used for other purposes or provided to a third party without user’s consent and Eastar Jet will be held responsible for any damage caused from doing so. However, the company won’t be held responsible in the following cases.
A. There is a special regulation in the legislation
B. Required for settling payment of provided service
C. Minimum amount of user’s personal information(name, address, phone number) must be told to a delivery company so delivery can be made
D. Required for statistics data, academic research or market research and information is provided to specific individual cannot be distinguished
④ In case user’s consent is required accordance to article 2 and 3, identity(affiliation, name, phone number, other contact) of administrator of personal information, the purpose of collection and use of personal information, whether information is provided to a third party or not(party receiving information, the contents of information, purpose and etc.) and issues specified in the law regarding the promotion of information and communication network use and protection of information article 22, section 2 will be posted on the website of Eastar Jet.
⑤ User can request for withdrawal accordance to article 2 and 3 at anytime and demand to view or correct errors in personal information. Eastar Jet will immediately take actions for user’s demands and in case user requests to correct error, Eastar Jet won’t be using that personal information until error has been corrected.
⑥ Eastar Jet is responsible to compensate for damages resulted from leak, loss, robbery, falsification of user’s information including information on credit card, bank account and etc. However, Eastar Jet won’t be held responsible in the following cases.
A. Information has been stolen due to user’s intention or negligence
B. User has provided personal information or entrusted the use of information to others.
C. User has entered false information on the application form for recovery of damages from information theft
D. User has made false statement to contractor’s request for confirmation of damage from information theft or did not cooperate
⑦ When personal information collected from user has served its purpose, Eastar Jet will terminate it without delay.
⑧ Details on user’s personal information and issues not mentioned in this agreement regarding protection of personal information will follow privacy statement of personal information from the website of Eastar Jet.
Article 14 (Eastar Jet’s responsibility)
① Eastar Jet will not commit acts forbidden by law, this agreement or against public order. The company will provide constant and stable service along with goods and services stated by this agreement.
② In order for users to use service safely, Eastar Jet will arrange security system for protection(including credit information) of personal information.
③ If user suffers damage due to unreasonable indication and advertisement stated in the article 3 of "the act on fair indication and advertisement" regarding Eastar Jet’s goods and services, the company will be held responsible for compensation.
④ Eastar Jet will not send advertising e-mails for profits if user does not want them.
Article 15 (Member’s responsibility for ID and password)
① Members are responsible for their ID and passwords unless in cases of article 13.
② Members must not allow a third party to use their ID and passwords.
③ If a member recognizes that his ID and password is stolen or being used by a third party, he must notify Eastar Jet immediately and follow instructions.
Article 16 (User’s responsibility)
User must obey this agreement and related law and must not commit following actions.
① Entering false information when making request or change
② Randomly changing information posted in the website of Eastar Jet
③ Sending or posting information or computer programs forbidden by Eastar Jet without consent
④ Violating copyrights and intellectual property of Eastar Jet and third parties
⑤ Violating honor and privacy of Eastar Jet or third parties and disturbing their business
⑥ Sending or posting messages, videos, voice files and other information that are indecent, violent and against public order
Article 17 (Relationship between Eastar Jet’s website and links)
Links are sites linked to Eastar Jet’s website using methods such as hyperlink(letters, images, dynamic images are included in the hyperlink). If Eastar Jet makes it clear that they won’t bear guarantee responsibility for independent deals the links make with users regarding goods and services on the initial screen or linked popup screen, then they won’t be held responsible.
Article 18 (Copyright’s belongingness and limit in use)
① Properties and other intellectual properties produced by Eastar Jet belongs to Eastar Jet.
② User cannot copy, send, publish, distribute, broadcast or use information earned from Eastar Jet’s website for profit or provide it to a third party without Eastar Jet’s consent .
Article 19 (Dispute resolution)
① Eastar Jet will reflect upon users’ reasonable suggestions and complaints to install and operate organization to compensate for losses.
② Eastar Jet will take measures for complaints and suggestions of users immediately and accurately. However, if company can’t take immediate measures, they will notify the users the reasons and processing schedule without delay.
③ If there is a dispute between Eastar Jet and user ‘s e-commerce, they can follow adjustment of E-Commerce Mediation Committee followed by Framework Act on Electronic Commerce and related laws.
Article 20 (Competent court and applicable law)
① Dispute regarding e-commerce between Eastar Jet and user will be brought to Seoul Central District Court.
② Disputes regarding e-commerce between Eastar Jet and user will be applied with domestic law.
Additional clauses
Article 1 (Effects of agreement)
This agreement is effective starting August 15th 2008 and it will be applied to members who joined before this agreement was in effect.
Article 2 (Revision of agreement)
Eastar Jet follows laws regarding this agreement, Framework Act on Electronic Commerce, Digital Signature Act, the law regarding the promotion of information and communication network use and protection of information, Framework Act on Consumers, the act on the consumer protection in the electronic commerce transactions etc, Act on the Protection of Personal Information and other related laws. Therefore, Eastar Jet’s membership agreement could be changed due to changes in government policies and domestic laws. If the agreement is changed, then effective date, the reason of change and contents of change will be posted on the internet website.

Eastar Jet Co., Ltd. (hereinafter referred to as the "Company" or "Eastar Jet") considers the protection of users' personal information important and complies with regulations for the protection of personal information in relevant legislations such as "Personal Information Protection Act" and "Act on Promotion of Information and Communications Network Utilization and Information Protection, etc."
The Company informs how and for which purposes the Company uses personal information offered by users and measures the Company takes to protect personal information by notifying the following personal information handling policy. The Company's Personal Information Handling Policy may change depending on changes in legislation and announcement or the Company's terms and conditions and internal policy; in cases of revision, the Company notifies changes to users or posts changes on the service screen.
Users are entitled to withhold consent for the collection, use, provision and consignment of the following personal information. However, when users withhold consent, whole or partial services cannot be used.
1. Purposes of personal information collection and use
Eastar Jet shall not use the personal information of the subject beyond the scope this article describes except for cases the subject of personal information agreed to or is defined by relevant laws.
A. Contract and pay settlement for services that have been provided
Sending various information emails for reservation and issuance of airline
tickets, delivery of various products such as airline tickets and souvenirs
and events, granting and reviewing qualification as best members, providing
customized services, verification of bank transactions and banking
services, purchase and collection of fees
B. Membership administration
Member verification regarding the membership service details, individual identification, protection from misuse by delinquent members and protection from unauthorized use, confirmation for the voluntary sign-up, limitation of sign-up and number of sign-ups, record preservation for resolution of the future dispute, complaints and requested issue handling, delivering of notifications
C. Use in the marketing and advertisement
Development and specialization of new services, provision of customized
services, service offering and advertisements according to the attributes
of demographic research, provision of information on products by the
company and affiliates, identification of access frequency, statistics
regarding the use of service by members, and delivering advertising
information and providing participation opportunity in the events. (User
personal information is not provided to individuals or groups which request
advertising.) Separate consent is required for use of personal information
for marketing and advertising purposes. Even when the user refuses to give
such consent, there will be no restrictions in the use of services.

3. Consent to Transfer of Personal Information to a Third Party
Eastar Jet uses a user's personal information to the extent notified in "Collection and Use of Personal Information." The Company does not use the information beyond that extent nor provide a third party with personal information without prior consent from the user. Exceptions to this are made in exceptional circumstances, such as where the user has given prior consent to the disclosure or provision of his or her personal information to a third party. Easter Jet is also obligated to provide a user's personal information in accordance with the law, or where a request has been made by crime investigation agencies or supervisory authorities pursuant to the procedure and methods of applicable laws for the purpose of crime investigation or inspection. These cases, however, are exceptions.

5. Overseas Transfer of Personal Information
Eastar Jet will transfer personal information overseas as follows to operate its reservation and transportation system. A user has the right to refuse to consent to such overseas transfer of personal information. If a user refuses to consent to overseas transfer of personal information, however, then the purpose of such overseas transfer cannot be achieved. Thus, there may be difficulties in the use of services.

6. Period for possession and use of person information
Eastar Jet possesses and uses customers' personal information for the period of providing services. When a user withdraws membership, the collected personal information is immediately destroyed to prevent its use or browsing of the information. However, when it is necessary to preserve the information in accordance with applicable laws, the information is preserved in accordance with such laws.

7. Procedure for the disposal of personal information
In principle, Eastar Jet will immediately destroy the collected personal
information when the purpose of collecting and using personal information is accomplished. The process and method of destruction is
as follows:
A. Destruction process
- Any personal information entered by a user for purposes such as membership subscription, after achievement of the purpose, will be destroyed for reasons of information protection. This is done as prescribed in Eastar Jet's internal policies and relevant laws.
- The aforementioned personal information, unless pursuant to relevant laws, will not be used for any purpose other than that of possessing the information.
B. Destruction method
- The personal information stored in the form of electronic file will be deleted using a technique which makes it impossible for the deleted information to be retrieved. The personal information printed on paper will be destroyed by shredding or incineration.
C. Introduction of the personal information usage period system
- Eastar Jet, to protect personal information of a long-term (1 year or more) non-user of service, began to periodically destroy such non-service user's personal information on August 18, 2015. The period of non-use of service will be calculated based on the date of final log-in. The necessary matters will be notified to the relevant users through emails, etc. at least 1 month before the aforementioned personal information is destroyed.
8. Rights and duties of users and legal representatives and methods to
exercise
A. User and legal representatives with authority are entitled to browse and
modify a member's personal information on "MYPAGE" of the website of Eastar
Jet. When requests are made through e-mail or in writing to staff members
in charge of managing personal information, the Company browses, modifies
or deletes the information. ID, name and date of birth cannot be modified,
but it can be exceptionally approved to change a name due to a changed
name. Cases where deletion or modification is prohibited or limited in
accordance with other legislations can be limited for processing. Further,
when requests are made to modify errors in personal information, such
personal information is not used or provided until the modification is
completed unless provision of personal information is requested by other
legislations. If incorrect personal information is already provided, result
of modification is notified to a third party for modification.
B. Users and legal representatives are entitled to request the suspension
of processing personal information on the website of Eastar Jet whenever
they want. However, requests for suspension can be rejected in the
following cases:
1) When it is inevitable to reject requests due to special legal
regulations or compliance with legal duties
2) When it is possible to damage the life and body of others or infringe on property and interests of others unfairly
3) When information holders do not express their willingness to cancel the contract in cases where implementation of the contract cannot be conducted such as when agreed services with information holders cannot be provided unless personal information is processed
C. Members can withdraw agreed contents for collection, use and provision of personal information with membership whenever they want. 6. Period for possession and use of person informationEastar Jet possesses and uses customers' personal information for the period of providing services. When a user withdraws membership, the collected personal information is immediately destroyed to prevent its use or browsing of the information. However, when it is necessary to preserve the information in accordance with applicable laws, the information is preserved in accordance with such laws.

7. Procedure for the disposal of personal information
In principle, Eastar Jet will immediately destroy the collected personal information when the purpose of collecting and using personal information is accomplished. The process and method of destruction is as follows:
A. Destruction process- Any personal information entered by a user for purposes such as membership subscription, after achievement of the purpose, will be destroyed for reasons of information protection. This is done as prescribed in Eastar Jet's internal policies and relevant laws.
- The aforementioned personal information, unless pursuant to relevant laws, will not be used for any purpose other than that of possessing the information.
B. Destruction method
- The personal information stored in the form of electronic file will be deleted using a technique which makes it impossible for the deleted information to be retrieved. The personal information printed on paper will be destroyed by shredding or incineration.
C. Introduction of the personal information usage period system
- Eastar Jet, to protect personal information of a long-term (1 year or more) non-user of service, began to periodically destroy such non-service user's personal information on August 18, 2015. The period of non-use of service will be calculated based on the date of final log-in. The necessary matters will be notified to the relevant users through emails, etc. at least 1 month before the aforementioned personal information is destroyed.
8. Rights and duties of users and legal representatives and methods to exercise
A. User and legal representatives with authority are entitled to browse and modify a member's personal information on "MYPAGE" of the website of Eastar Jet. When requests are made through e-mail or in writing to staff members in charge of managing personal information, the Company browses, modifies or deletes the information. ID, name and date of birth cannot be modified, but it can be exceptionally approved to change a name due to a changed name. Cases where deletion or modification is prohibited or limited in accordance with other legislations can be limited for processing. Further, when requests are made to modify errors in personal information, such personal information is not used or provided until the modification is completed unless provision of personal information is requested by other legislations. If incorrect personal information is already provided, result of modification is notified to a third party for modification.B. Users and legal representatives are entitled to request the suspension of processing personal information on the website of Eastar Jet whenever they want. However, requests for suspension can be rejected in the following cases:
1) When it is inevitable to reject requests due to special legal regulations or compliance with legal duties2) When it is possible to damage the life and body of others or infringe on property and interests of others unfairly

6. Period for possession and use of person informationEastar Jet possesses and uses customers' personal information for the period of providing services. When a user withdraws membership, the collected personal information is immediately destroyed to prevent its use or browsing of the information. However, when it is necessary to preserve the information in accordance with applicable laws, the information is preserved in accordance with such laws.

7. Procedure for the disposal of personal information
In principle, Eastar Jet will immediately destroy the collected personal information when the purpose of collecting and using personal information is accomplished. The process and method of destruction is as follows:
A. Destruction process- Any personal information entered by a user for purposes such as membership subscription, after achievement of the purpose, will be destroyed for reasons of information protection. This is done as prescribed in Eastar Jet's internal policies and relevant laws.
- The aforementioned personal information, unless pursuant to relevant laws, will not be used for any purpose other than that of possessing the information.
B. Destruction method
- The personal information stored in the form of electronic file will be deleted using a technique which makes it impossible for the deleted information to be retrieved. The personal information printed on paper will be destroyed by shredding or incineration.
C. Introduction of the personal information usage period system
- Eastar Jet, to protect personal information of a long-term (1 year or more) non-user of service, began to periodically destroy such non-service user's personal information on August 18, 2015. The period of non-use of service will be calculated based on the date of final log-in. The necessary matters will be notified to the relevant users through emails, etc. at least 1 month before the aforementioned personal information is destroyed.
8. Rights and duties of users and legal representatives and methods to exercise
A. User and legal representatives with authority are entitled to browse and modify a member's personal information on "MYPAGE" of the website of Eastar Jet. When requests are made through e-mail or in writing to staff members in charge of managing personal information, the Company browses, modifies or deletes the information. ID, name and date of birth cannot be modified, but it can be exceptionally approved to change a name due to a changed name. Cases where deletion or modification is prohibited or limited in accordance with other legislations can be limited for processing. Further, when requests are made to modify errors in personal information, such personal information is not used or provided until the modification is completed unless provision of personal information is requested by other legislations. If incorrect personal information is already provided, result of modification is notified to a third party for modification.B. Users and legal representatives are entitled to request the suspension of processing personal information on the website of Eastar Jet whenever they want. However, requests for suspension can be rejected in the following cases:
1) When it is inevitable to reject requests due to special legal regulations or compliance with legal duties2) When it is possible to damage the life and body of others or infringe on property and interests of others unfairly
3) When information holders do not express their willingness to cancel the contract in cases where implementation of the contract cannot be conducted such as when agreed services with information holders cannot be provided unless personal information is processed
C. Members can withdraw agreed contents for collection, use and provision of personal information with membership whenever they want. As for withdrawal of consent, the Company takes necessary measures such as deletion of personal information without delay when users click "Withdrawal of membership" on the Company's website or contact staff members in charge of managing personal information in writing, on the phone or by e-mail. However, when the Company needs to preserve personal information of members in accordance with regulations of terms and conditions, processing of personal information can be limited. In such cases, members should notify their IDs and identification information to identify personal information, and some services are restricted or blocked due to withdrawal.
9. Protection of children's personal information
Membership is permitted only for people of the age of 14 and over to protect personal information of children below the age of 14, and the Company does not collect children's personal information.

Installation, operation and rejection of devices to automatically collect personal informationThe Company can install and operate cookies, which store and find customer information through provided Internet services. A cookie is character string information which is stored by a web server on a web browser and is sent for additional requests by the server. When customers access the website of Eastar Jet, the Company can provide customers with services without inputting additional information such as names by reading the contents of the cookie and finding additional information.
A. Customer information which is collected through cookies can be used for the following purposes:
1) Providing differentiated information depending on each sector of personal interests;

All personal information is safely encrypted and transferred on the network.Further, the company controls external access without permission by using a system for blocking infringement and strives to use every possible technical device to ensure security in other systems.
C. Minimization of employees in charge of processing personal information and education for the employees
